Fence Permits in Wesley Chapel: Five CDDs, One County Rule
Wesley Chapel follows Pasco County's own fence rule - but five CDDs are registered here, per the county's own election registry. Check your HOA; call the county for permits.

Wesley Chapel’s public fence rule is simply unincorporated Pasco County’s own material-based exemption - nothing about that rule is unique to this place. What’s unique is who’s registered here: five Community Development Districts at Wesley Chapel addresses - Mitchell Ranch, Oak Creek, Oakstead, The Groves, The Verandahs - confirmed from the Supervisor of Elections’ own special-district registry, not a real-estate blog. Two of them share management-suite addresses, which I’m flagging as a discrepancy and leaving open rather than resolving into one location. Wesley Chapel itself is a census-designated place, not a municipality: no city council, no permit office, no code of its own.
Wesley Chapel sits in unincorporated Pasco County, which administers its own code directly - there’s no city layer in between. A CDD finances infrastructure; a homeowners association reviews a fence design; the two are legally separate even inside the same subdivision. No county-level fence price differential is established anywhere in our research. See the service area overview and Tampa Bay fence permit guide for the rest of the metro.
Who to call: two separate Pasco offices
Wesley Chapel has neither a city hall nor a permit desk, so both questions route to the county. Building Construction Services, 8661 Citizens Drive, New Port Richey, handles permits at (727) 847-8126, option 5. Planning and Development handles setback and code questions at (727) 847-8140 - a formally separate office from the one that issues the permit.
Confirmed rules: the county’s own numbers
The material exemption first: no permit for a fence made entirely of chain link, wood, PVC or shrubbery; a permit is required only where footers or other structural or masonry components are used. Front yard or in front of the dwelling tops out at 4 ft, side and rear at 6 ft, and the finished side must face the adjoining lot or right-of-way. Then the facts that actually earn this page its length. §1003.1.G bans chain link, welded wire or similar fencing visible from a collector or arterial road unless the property is zoned industrial - county-wide, and new since our earlier research round. §1003.3.B covers corner and double-frontage lots: 4 ft in the front yard parallel to the principal building line, 6 ft in the other front yard if it meets the district setback, with a written-determination route for the “front door.” The clear-sight triangle lives at §530.6, not §530.7 as I’ve seen it cited elsewhere - 3.5 ft, points 20 ft from the intersection of right-of-way lines, per FDOT Index 546. And §1003.1.D’s 50% rule: if half or more of a non-conforming fence is damaged, destroyed or removed, it must be rebuilt to current code - a conformity threshold, not a permit threshold, and I’d never merge the two. Separately, none of the three counties, this one included, publishes a threshold at which repairing rather than replacing a fence alone triggers a permit - that question stays open regardless of the 50% rule above.
| Rule | Limit / value | Section | Codified |
|---|---|---|---|
| Material exemption | No permit for chain link, wood, PVC, shrubbery; permit required for footers/masonry | LDC §1003 | Ch. 1000, Gates, Fences and Walls |
| Dimensional baseline | Front yard/in front of dwelling 4 ft; side/rear 6 ft | LDC §1003 | same |
| Chain-link/collector-road ban | Banned if visible from collector or arterial road unless zoned industrial | §1003.1.G | Ord. 24-45 (12 Nov 2024); through Ord. 26-22 (16 Jun 2026) |
| Corner/double-frontage lots | 4 ft front yard parallel to principal building line; 6 ft other front yard if setback met | §1003.3.B | same supplement |
| Clear-sight triangle | 3.5 ft, points 20 ft from intersection, FDOT Index 546 | §530.6 | Pasco County LDC |
| 50% conformity rule | Half or more damaged/destroyed/removed must rebuild to current code | §1003.1.D | Pasco County LDC |
The CDD list, and the HOA check
Five districts, one registry: Mitchell Ranch, Oak Creek, Oakstead, The Groves and The Verandahs, all registered at Wesley Chapel, FL 33544 addresses per the Pasco County Supervisor of Elections. Two share management-suite addresses - registered-office addresses, not neighborhood locations, and I’m stating that discrepancy rather than resolving it. A CDD’s default authority under Fla. Stat. ch. 190 is infrastructure - roads, drainage, utilities. Aesthetic control of a private lot belongs to a legally separate homeowners association under Fla. Stat. §720.3035. No source ties any of these five CDDs to a fence-specific design review, so the honest line is “expect an HOA step, check yours,” never “the CDD requires.” I’ve had a homeowner insist her CDD would sign off on a fence design; it was her HOA all along, and the CDD had never reviewed a fence in its history.
What a Wesley Chapel fence permit costs
A standard exempt fence under the county’s material test runs $0 in permit fees. There’s no published figure for the footer-or-masonry exception case in our research. The §468.631/§553.721 state surcharge only applies where a permit issues at all - worth knowing, since most fences in unincorporated Pasco never trigger one.
Licensing: the buyer is the vetting authority
Pasco County has no fence-installer license category - a closed, numbered list of 32 trade categories, revised January 2, 2024, and “fence” never appears on it. For the fuller CDD-versus-HOA legal mechanics, see HOA fence approval; for measurement conventions, see fence height and setbacks.
Confirm with your office before you build
Even a job that clearly fits the county’s material exemption is worth a call to Planning and Development if a corner lot, a collector road or a non-conforming repair is involved - and a check with your own community’s association either way.
FAQ
Does Wesley Chapel require a fence permit? Same material-based exemption as anywhere in unincorporated Pasco: no permit for chain link, wood, PVC or shrubbery; a permit is required only for footers or masonry. Wesley Chapel has no city office of its own, so every question routes to the county.
What CDDs are in Wesley Chapel, and does that mean stricter fence rules? Five, per the Supervisor of Elections’ own registry: Mitchell Ranch, Oak Creek, Oakstead, The Groves and The Verandahs. A CDD isn’t the same as an HOA, and no source confirms any of them reviews fence design - check your own community’s association instead.
Can I put up a chain-link fence facing the road? Not if it’s visible from a collector or arterial roadway, unless the property is zoned industrial. That’s §1003.1.G, new since our last research round, and it applies county-wide, not just here.
Land O’ Lakes sits under the same county authority as Wesley Chapel - see fence permits in Land O’ Lakes if you’re comparing notes on a nearby unincorporated address.
